Terms & Conditions

Before launch: replace all bracketed business details and have the final terms reviewed for the countries you actively target. This starter text is designed for a European consumer e-commerce store and does not override mandatory consumer law.

1. Seller information

The Nestory online store is operated by [LEGAL COMPANY NAME], registration number [REGISTRATION NUMBER], registered address [REGISTERED ADDRESS]. Contact: [CUSTOMER SUPPORT EMAIL].

2. Scope

These Terms apply to consumer purchases made through nestory.eu. By placing an order, you agree to these Terms together with the information shown during checkout. Mandatory consumer rights applicable to you remain unaffected.

3. Products and availability

We aim to describe products accurately. Colours and appearance can vary slightly between screens and production batches. Product availability is subject to stock. If an ordered product becomes unavailable, we will contact you and refund any amount paid for the unavailable item if it cannot be supplied.

4. Prices and payment

Prices displayed to consumers include applicable taxes where required. Delivery charges and the final payable total are shown before the order is placed. Available payment methods are displayed during checkout. An order is not accepted until payment and order checks are completed and you receive our order confirmation.

5. Delivery and fulfilment

Products may be fulfilled from different European warehouses or brand partners. Items in one order may therefore arrive in separate parcels. Delivery options and estimated times are shown at checkout. We are responsible for arranging delivery when you use the delivery option offered by us.

6. Right of withdrawal

Where EU consumer law applies, eligible online purchases generally include a 14-day right of withdrawal beginning when you receive the goods. To exercise this right, send us a clear statement before the withdrawal period expires. We will provide return instructions.

You are responsible for the direct return cost unless we state otherwise or the law requires us to bear it. Statutory exceptions to withdrawal may apply to certain categories such as personalised goods, goods liable to deteriorate rapidly, or certain sealed goods after opening.

7. Refunds after withdrawal

Where required by law, we refund eligible payments, including the cost of the least expensive standard delivery option we offered, using the original payment method. We may withhold the refund until we receive the returned goods or you provide evidence of return, where permitted. You may be responsible for diminished value caused by handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

8. Faulty goods and legal guarantee

Consumers in the EU have statutory remedies for goods that are faulty, not as described or otherwise non-conforming. EU rules provide a minimum two-year legal guarantee for new consumer goods, subject to applicable national law. Depending on the circumstances, remedies can include repair, replacement, price reduction or refund.

9. Returns procedure

Do not return products to an address found on packaging without contacting us first. Different products may have different authorised return locations. Using the return instructions we provide helps avoid delays or lost returns.

10. Accounts and website use

You are responsible for keeping your account credentials secure and for providing accurate information. You may not misuse the website, interfere with its operation, attempt unauthorised access, or use content in a way that infringes intellectual-property rights.

11. Intellectual property

The Nestory name, visual identity and original website content belong to their respective rights holders. Product names, logos, photographs and other brand materials may belong to the relevant manufacturers or suppliers.

12. Liability

Nothing in these Terms excludes liability or consumer rights that cannot legally be excluded. To the extent permitted by law, we are not responsible for losses that were not reasonably foreseeable or for delays caused by events outside our reasonable control.

13. Complaints

If you have a problem with an order, please contact us first so we can try to resolve it. You may also have rights to use consumer dispute-resolution bodies available in your country.

14. Governing law

These Terms are governed by the laws applicable to the seller, without depriving consumers of mandatory protections available under the law of their habitual residence where those protections apply.

15. Changes

We may update these Terms for future orders. The version in force when you place an order applies to that order.
